Contrary to the claims of conservative reactionaries and religious demagogues, the stipulation in the Affordable Care Act that requires health institutions to provide contraceptive care does not encroach upon religious freedom. The aforementioned provision does not, in any way, inhibit worship or violate the first amendment to the American constitution; it is simply a continuation of the basic rights and privileges we afford workers.
If, for instance, a religious group believed compensation for manual labor was a grave offense—punishable by execution—they would not be exempt from providing wages to their employees. The same principle applies here. Simply believing something is morally reprehensible is not enough to repudiate federal law.
But does the government have the right to impose sanctions on a place of worship? Of course not. It does, however, have an inherent obligation to protect the rights of individuals who are afflicted, tyrannized, or impaired by religious mandate. To those who advocate the division of church and state, even in the event of subjugation, torture, and misery, I offer you these moral distillations:
“You may treat [the slaves you buy] as your property, passing them on to your children as a permanent inheritance.” (Leviticus 25:44-46)
“Thou shall not suffer a witch to live.”(Exodus 22:18-20)
“Wives, submit yourselves unto your own husbands, as unto the Lord.” (Ephesians 5:22-24)
“If a man lies with a male as with a women, both of them shall be put to death for their abominable deed; they have forfeited their lives.” (Leviticus 20:13)
Has the dissipation of these precepts, through government intervention, prevented anyone from exercising their faith? Does the 19th Amendment to the Constitution infringe upon the rights of those who believe in the patriarchy? Will the allocation of contraceptives diminish religious freedom? Emphatically, no.
The opposition to contraceptive care is an assured instance of religious intransigence. Emancipating women from the abject cycle of reproduction is a necessary and fundamental step in reaching equality and reducing poverty, and those who preach otherwise are perpetuating the needless suffering of countless men, women, and children.
